Agreement to These Terms
These Terms & Conditions (“Terms”) form a legal agreement between you and There Will Be Dough (“we,” “us,” or “our”), governing your use of our website at therewillbedough.com and the ordering, booking, and SMS services it provides. By using the site, placing an order, or texting with us, you accept these Terms. If you do not agree, please do not use the service.
Eligibility
You must be at least 13 years old to use this site, and at least 18 (or the age of majority in your jurisdiction) to place an order or enter into a booking agreement. By using the service you represent that you meet these requirements.
Orders & Pickup
- Each drop has limited capacity and is offered first-come, first-served while supplies last. We reserve the right to cancel or limit an order if an item sells out between your reservation and our acceptance.
- After payment, we will email you the pickup address, time window, and a pickup code. Treat the address as private and do not share it publicly.
- You are responsible for picking up your order within the stated window. If you cannot make it, contact us as early as possible. We are not obligated to refund orders that are not picked up.
- We may take photos of food and the event for marketing use. If you would prefer not to appear, please let us know on site.
Payments & Pricing
All prices are listed in U.S. dollars and exclude any applicable taxes unless explicitly stated as tax-inclusive at checkout. Payments are processed by Stripe; by paying you also agree to Stripe's end-user terms. We never see or store your full card number.
Optional tips collected at checkout go to the team. We may correct obvious pricing errors and, if a charge has already been captured at an incorrect price, refund the difference or cancel the order.
Refunds & Cancellations
- Before order close: Need to cancel before the order window closes? Email hello@therewillbedough.com with your pickup code and we will refund in full to the original payment method.
- After order close / day of: We have already ordered ingredients and prepped dough for your order, so refunds at this point are at our discretion.
- Something went wrong: If your pizza is not what was ordered or arrives in unacceptable condition, tell us at the booth or email within 24 hours and we will make it right — remake, comp, or refund.
- No-shows: Orders that are not collected within the pickup window are not eligible for an automatic refund.
Private Bookings
Booking inquiries submitted through our site are quotes requests, not confirmed bookings. A booking is confirmed only after we send a written acceptance and (when applicable) a deposit is paid. Deposits, minimums, travel fees, cancellation windows, and weather contingencies for private events are spelled out in the individual booking agreement.
SMS Notifications
By providing your mobile number at checkout, you agree to receive a transactional SMS from There Will Be Dough notifying you that your order is ready for pickup. Message and data rates may apply. Message frequency varies based on your order activity (typically one message per order).
Reply STOP to opt out at any time, or HELP for help. You can also email hello@therewillbedough.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for details on how phone numbers are handled.
Acceptable Use
You agree not to:
- Use the site to violate any law, infringe anyone's rights, or send unlawful, harassing, or fraudulent content.
- Attempt to interfere with, probe, scan, or compromise the site's security, or use it for automated mass requests without our written permission.
- Resell, redistribute, or otherwise commercially exploit content from the site without our written permission.
- Place fraudulent orders or use someone else's payment method without authorization.
We may suspend or terminate your access to the service if you violate these Terms.
Intellectual Property
The site, including its text, images, logos, recipes, designs, and code, is owned by There Will Be Dough or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes only.
User Submissions
If you submit a poll vote, booking message, guestbook entry, testimonial, or photo, you grant us a worldwide, royalty-free, non-exclusive license to use, display, and reproduce that content in connection with the service and our marketing. You represent that you own or have the right to share what you submit and that it does not violate anyone's rights or applicable law.
Third-Party Services
The site uses third-party services (such as Stripe for payments, Twilio for SMS, Resend for email, Google Firebase for storage, and Vercel for hosting). Your use of those services is also governed by their respective terms and privacy policies. We are not responsible for the practices of third parties.
Disclaimer
The site and our service are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free. We are not responsible for the unavailability or delay of carrier-provided SMS messages.
Allergens. Our menu items are prepared in a shared kitchen environment where wheat, dairy, eggs, soy, and other allergens are present. We cannot guarantee that any item is free from any specific allergen. If you have a severe allergy, please contact us before ordering.
Limitation of Liability
To the maximum extent permitted by law, There Will Be Dough, its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or related to your use of the site or service.
Our total liability for any claim arising out of or relating to these Terms or the service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.
Indemnification
You agree to defend, indemnify, and hold harmless There Will Be Dough and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your violation of these Terms or your misuse of the service.
Governing Law
These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. Nothing in this section affects any rights you have that cannot be waived under applicable law.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be announced in a reasonable way, such as by posting a notice on the site. Continuing to use the service after changes take effect means you accept the updated Terms.
